Month to Month - Basic

The Month to Month Basic Membership includes:

- Full Gym Access, Dry Sauna, Cold Plunge & Dressing Rooms

- 12 Fitness Classes per month

- 5% OFF Spa Services, Monday to Thursday

Month-to-Month Membership Terms and Conditions Term and Monthly Billing

By enrolling in a month-to-month membership, the member agrees to ongoing monthly participation with no fixed-term commitment. Membership fees are charged monthly in advance, on the first (1st) day of each month, and will continue automatically unless and until properly canceled in accordance with these terms.

Cancellation; No Refunds or Credits

The member may cancel their month-to-month membership at any time by providing written notice at least thirty (30) days prior to the next billing date. Cancellation will become effective at the end of the then-current billing period.

No refunds, credits, or chargebacks will be issued for any unused portion of a billing period, including but not limited to non-use, illness, injury, relocation, travel, dissatisfaction, or changes in personal or financial circumstances. All membership fees are deemed fully earned once the applicable billing period has commenced.

Access and Facility Rules

The member is granted access to gym facilities and standard amenities during normal operating hours, subject to posted rules, capacity limitations, and reasonable operational changes. The member agrees to comply with all facility policies, as amended from time to time. Access may be suspended or terminated for violations of facility rules or conduct policies, without refund.

Assumption of Risk

The member voluntarily assumes all risks associated with physical exercise, use of equipment, and participation in gym and wellness activities, including risks of injury, illness, or other physical harm.

Release and Limitation of Liability

To the maximum extent permitted by applicable law, the member releases and holds harmless the operator, its owners, employees, agents, and affiliates from any and all claims or liabilities arising from participation in activities or use of the facilities, except in cases of gross negligence or willful misconduct.

Non-Transferability

This membership is personal to the member and non-transferable.

Entire Agreement and Amendments

This agreement constitutes the entire agreement between the parties and supersedes all prior understandings. Any amendment must be in writing and signed by both parties.

Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Baja California Sur, Mexico. The parties agree that exclusive venue for any dispute, claim, or proceeding arising out of or relating to this Agreement shall be in the Municipality of La Paz, Baja California Sur, Mexico, and each party irrevocably submits to the jurisdiction of such venue.

Acknowledgment

The member confirms that they have read, understood, and accepted these month-to-month membership terms, including the billing and cancellation policy, and acknowledges that these terms were clearly disclosed prior to enrollment.
